We published this transcript earlier. We are posting it again with the audio-recording so readers can hear for themselves what transpired in court during the hearing when Dr Chee Soon Juan cross-examined Mr Lee Kuan Yew.

CSJ: Mr Lee, we get to meet at last.

LKY: (pause)...Sorry?

CSJ: We get to meet at last.

LKY: I thought we've met many other times across election rallies.

CSJ: Your memory fails you. I've never met you before and you know why? Because you keep avoiding me. (Mr Lee laughs) Well, we have this opportunity right now. Let me ask you this question. You gave an interview saying: "If you defame us, and if I'm involved, I go to the the witness box and you can question me not only on the particular defamation issue, but on all issues in my life." Do you stand by your words?

LKY: I do.

CSJ: Good. In the course of the cross-examination, will you then answer questions not just on this particular defamation issue, but on all issues in your life -- and I don't mean your personal life, I mean your political life? Will you stand by that?

LKY: Your Honour, we appeared in court when the issue was whether or not the summary judgment was proper. That was the time to challenge --

CSJ: Mr Lee, that was not my question.

Judge: Allow the witness to answer. Mr Lee, please go on.

LKY: I have to answer. I'm a lawyer. I no longer practice the law. I know your purpose. You dodged that occasion and you're trying -- Dr Chee is trying today when the issue is the question of quantum of damages, it's not liability. I'm here to answer questions relating to the quantum of damages.

CSJ: Thank you. Then why is it that you say you will go to the witness box --

LKY: I have already explained that, Your Honour --

CSJ: -- and answer questions not just particular to this defamation issue but on all issues of your life. Now tell me, are those just brave words meant for public consumption and in this situation right now you're turning tail and running?

LKY: Ha ha ha, no Your Honour --

CSJ: Good. Then you won't mind me asking you why is it that you make this application to cut short your cross-examination precisely when you walk in at noon and say that you have to be stopped in the cross-examination by 2:15 giving me. the defence, only two hours and fifteen minutes, and then insisting that all of us can't go for lunch. And on top of that refusing to tell the court what this "important matter" you have this afternoon is.

LKY: That's...Your Honour...(pause)

CSJ: I'm lost for words too as I think you are right now.

LKY: ...(pause; Mr Lee was seen opening his mouth to answer but no words came out)

CSJ: Go ahead, Mr Lee.

LKY: ...(pause)

CSJ: No answer? That settles the question then.

LKY: Ha ha ha.

Judge: Dr Chee!

CSJ: Fine, let Mr Lee continue. I'm just waiting. He's probably lost for words because he doesn't quite know what to say at this stage.

Judge: If you keep interrupting the witness...Yes, Mr Lee.

LKY: ...(even longer pause)

CSJ: Please don't run down the clock. I've only got a few minutes.

At this stage, Mr Davinder Singh jumped in to bail out Mr Lee.

Singh: What is the question? Dr Chee has made so many points in his speech. He has already been told that the time to cross-examine the witness was during the summary judgment. If he had leave to defend. All issues would have been open for Dr Chee to have questioned him. The witness said that for Dr Chee to have questioned him. The witness said that Dr Chee had dodged that application and is now trying through the back door to introduce impermissible material. The witness said he is here as he said to answer questions on quantum. Dr Chee should really get on with the issue of quantum.

CSJ: Let me ask the question again. Mr Lee, you have said that you are here to answer these questions and I say that in that case why did you make an application to, halfway through the session, want the court to cut short this entire hearing. Now, I remind you that we have got until the end of tomorow, the end of tomorrow. So we have one-and-a-half days. But you insist that we have to finish by 2:15 for you to attend to some matters that you won't even reveal to the court. Now I ask you now does this sound like somebody who's willing to come to court and meet and resolve these issues?

LKY: Your Honour, I had a message from one of my counsel's aides to say that I should be in court by here 2 o'clock - by 12 o'clock because Your Honour has imposed a guillotine that the cross-examination of the prime minister would end at twelve. So I turn up at twelve. I was told that the guillotine allowed - had already been late he would be given 2 hours. I suggest - I asked my counsel to request the court to finish this two hours so that I can attend to some important matters. There's no disadvantage to anybody to be sitting here and finishing off this cross-examination within the two hours. What I do not want to be a party to is a deliberate abuse of the process, of the proceedings of the court by delaying tactics.

CSJ: So, Mr Lee --

LKY: And by asking irrelevant questions, Dr Chee is running out the gullotine. At the end of the day, we've had this confrontation face to face have you thrown any dirt, have you dug up any scandal? Are you still saying as you've said before that this government is run like the NKF?

CSJ: Now, Mr Lee, let me try to --

LKY: No, we are here because you have said that --

CSJ: Mr Lee, I'm going to ask you this question and I wish you'd just stick to the questions that I pose to you. I'm asking you why did you come to court --

LKY: Because I was asked --

CSJ: Let me rephrase my question. Are you telling the court that you had nothing to do with the curtailment of this entire process?

Singh: Your Honour, I made the application this morning and Your Honour would remembers that I said I was very troubled with what the Chees did yesterday and that it was quite apparent that they had nothing to ask which was of any relevance and that unfortunately or otherwise has been proven in this exchange. And I said, Your Honour, that the whole purpose of the cross-examination was to insult, annoy and to scandalise and that's also been proven true. For that reason, I had asked that there be a guillotine. Your Honour had full powers to control the proceedings. The order has already been made and I don't see why this witness should be asked to explain something that was the subject of my application and Your Honour's order.

CSJ: Do you see the game that's being played here, Mr Lee? Do you see how you are beginning to hide behind your counsel and then claim, "Look, I'm willing to confront them. It's my counsel." Now I'm going to ask you a very simple question: Right here, right now, tell Mr Davnder Singh "Don't interrupt. I will answer these questions as they are put to me right now."

LKY: Heh-heh. Your Honour, I've briefed counsel, I've always found it's never wise to be my own lawyer in my own case. I know that some perople believe that they can do otherwise, and I'm quite sure that Dr Chee is making a very great impression on all the reporters in this court of how he is better than Mr Ravi --

CSJ: I think you meant Mr Singh.

LKY: I believe Mr Singh is better qualified to deal with the legalities of this case.

CSJ: Well, I should hope so with all the training that he's got. Now, coming back to my question, Mr Lee, is your answer no, that you wll not tell Mr Singh: "Stay out of this. Let me answer my question because --

LKY: I --

CSJ: Let me finish my question -- because you have said -- and I repeat to you -- that you will answer not only questions about the "particular defamation issue, but on all issues in my life."

LKY: Yes...as long as that was what was an issue and that was the, it was an issue in the summary judgement was appealed against. [Note how garbled the answer is.] And we turned up for the hearing but you dodged the hearing.

CSJ: Mr Lee, you are not unintelligent.

LKY: Thank you.

CSJ: You knew precisely what you meant and what you mean is: "Come and ask me all these questions that doesn't pertain to this defamation suit and I will answer you because my entire standing, inlcuding the standing of this government, is at stake." Is that not correct?

LKY: I think, Dr Chee, we'll cut short this proceeding to become more relevant.

    Amamzing... actually with matters involving our ministers, the local media should cover these cases LIVE audio on national TV or radio. We need to see/hear the entertainment. We paid for it with our "hard earned" money (taxes). But only can see ugly sketches of them on TV and a 3rd party perspective which might be biased.

    I think CSJ is asking too many questions.

    What's the point?

    There's no technic at all..

    It shows the blunt side and that's why CSJ is in jail for that rudeness.

    If it had been more tactful during questioning, CSJ would have been a free man now, though a bankrupt still.

    Court trials should be telecast openly to allow people to witness for themselves. And not be held under a cloak of secrecy & censorship.

    Clearly, the media has spun a web of deceit-- by only publishing selective court proceedings that puts the Chees in a bad light.

    Local media reports should practice more on Political freedom and media freedom. It will be the absence of interference with the sovereignty of an individual by the use of coercion or aggression.

    If local media are not facing the obstacles of media freedom, Singapore citizens can be able to observe who is ownership is the state or fact of exclusive rights and control over Rules of Law or who is that communication of a statement that makes a false claim! during the hearing in the court.

    We have to ask this question to media Bosses, What are the roles and responsibilities of Media?

    I thought witnesses in court are only to provide facts in answer to questions, and not to intrepret and pass their own judgement. It is for the defence and plaintiff's counsels to form judgements and draw conclusions, and for the judge to make the last judgement.

    Yet, Lee at several points evaded giving straight factual answers and contended with Chee instead, sayings things not relevant to the issue of quantum of damages.

    And the judge never checked Lee.

    Although, I am not a PAP support, I am unsure why SDP put this sound clip. I can't help but feel that CSJ is too dramatic and put himself in a bad light.

    I don't think this will help SDP's fight for democracy. I am very disappointed!

    Sigh... if you want to demolish someone, at least stand look at both side of the fence before you yak away. In the same context as yours, I can say:

    PAP is really coward ... Why don't even dare to put out even a single minute of the court session? Are they scared? Why no put at all? Afraid that it is not to PAP advantage? Now who is the real hypocrite of Singapore !!!

    Next time, think before you write, else even if you comments may be published, but you will be as quickly demolished.

    Thank you so much for the audio!!! It added a lot of credibility, especially since it present such a radically different picture than the mainstream media reports.

    If this is such a large event as what LKY seems to indicate, then the entire proceeding need to be televised on national TV. However, the media is hiding the truth and selectively report on a small fraction of the proceeding that is only benefitial to them. This is such a cowardly act.

    Anyone knows how to put the audio recording on YOUTUBE and GOOGLE VIDEO? It would reach a large audience, and counter the effect of the mainstream video. Too bad I am not technical enough to know how to do it. CAN ANYONE PLEASE HELP?

    Literally,Messiah means "The Anointed (One)", Figuratively, anointing is done to signify being chosen for a task; so, Messiah means "The Chosen (One)", particularly someone divinely chosen.

    I don't think Dr. Chee was asking too many questions. If you look closely, these are the main questions that he asked:

    If it seems like he asked alot of questions, that's because he didn't seem to get very adequate answers... :)

    We used to believe in Lee and his gang so fervently. After all these years, we surely do not want to rely on one man and a party. Lee has changed for the worst. It is Singaporean who should save themselves. Messiah is a word that I am sure Chee will not want to be associated with.

    hey, that exchange sure is full of potentially contentious viewpoints as to how each side performed/behaved. but let's not split hairs till we see the whole picture. indeed i echo some readers' request that the whole clip be put up here, for us to have the fuller picture. i am sure it will help illuminate more wholesomely and clearly to all the truth - in whoever's favor it might be, let the whole picture (hearing) be out.

    SDP is the party that started to release audio recording and transcript and as usual taken out of context to SDP advantage which I think is childish.

    It is as good as 2 people arguing and then 1 of them goes around telling the whole world portion of the argument that is beneficial to himself.

    If SDP intends to let Singaporean be the judge, then SDP should release the FULL version not partial.

    I visit SDP website because I wish I can hear the WHOLE story and not PARITAL. If SDP chooses to release the court proceeding in the first place, please for goodness sake, do it fully.

    Either you do it (SDP-parital release) or you don't do it at all (PAP-never release).

    Through out the whole audio clip, LKY did not answer Dr Chee and single question. Dr Chee asked if LKY would answer any single questions posed to him on his political life etc. LKY said he would.

    But when LKY lawyer speaks up for him, Dr Chee asked if LKY can ask his lawyer to remain silent and let LKY to answer the questions himself. But LKY said that he had instructed to his counsel on all these, hence his counsel will speak up for him.

    I thought he promised earlier that he would answer Dr Chee's question? Now he's hiding behind someone hoping that someone would speak up for him!

    After hearing this recorded conversation, then i know that he's not as smart as what i think at all.

    Hmm.. interesting that you mention this. Do you read our world ranked 154th Straits Time and watch the TV? Had you noticed how one sided it was, and still is, with regards to this case?

    Surely if you have to come to SDP website to try understand the full story, then obviously you felt that you do not get the whole story on the TV or the Straits Time. Now, did you write to Straits Time and MediaCorp as well demanding that they either report it fully and unbiased, or don't do it all?

    If you didn't, I will suggest that you begin writing those letters to be fair, and if you did, I am looking forward to see the replies from them. Please post them here, I am sure many readers here will love to see them as well.

    There is a section which says:
    [i]At the beginning of the hearing this morning counsel for Ms Chee, Mr M Ravi, argued that the transcript Judge Ang used for citing instances of contemptuous conduct came from Merrill Legal Solutions, a company contracted to record and transcribe proceedings.

    The Lees' lawyers of Drew & Napier had paid for Merrill's services. A copy of the transcript was then extended to Judge Ang.

    Mr Ravi pointed out that documents that were relied on by the court had to be made available to all parties. The defendants were not provided copies of the full transcript.

    When Dr Chee approached Merrill earlier, he was informed that because Drew & Napier had applied for the transcription servicess, a copy could not be given to him. The defendant was told he would have to contact the Lees' lawyers.[/i]

    We can see that there are quite a bit of hindering factors for SDP to obtain the full transcript. Maybe even now they do not have the full transcript and hence, they release what they can, as they get it. Be thankful for that because you and I both know who have the full transcript and they will never release it willingly to the public.

    Now, how about you start petitioning LKY and LHL to tell the full story and release the full transcript, fully uncensored, instead of all the one sided reports in Straits Time and TV? At the same time, might as well throw in a petition for them to answer all the unanswered questions that Dr Chee asked as well, we will like to know these answers too.

    I still don't it that WHY Dr Chee keep on insisting that LKY answer why LKY have to cut short the cross-examination to 2 and 1/2 hrs? Can't Dr Chee just use the 2 and 1/2 hrs to ask those important question about the case? Why is so important to know what LKY have to do after the 2 and 1/2 hrs?

    :0 Chee should know about the way laws operate. When you are in court for one offense you only deal with that offense complaint by the Plaintiff.

    What Lee said about what he has said is not for the court to deal with and not for Chee to expose the plaintiff even though he has said something before.

    Play footabll and play hockey need diffrent goal post. This court case demonstrated Chee is ill adviced or if not a stupid act and kenna conned by Lee.

    In court, there is certain rules to follow and court is like cooking and you do one thing only, and only one thing at a time to make the food taste good.

    History has shown countless times that all dictators are not only mere cowards but also criminals. The very nature of the trial and its injustice and inhumanity can be seen right away by any self-respecting human being. Dr Chee has very clearly exposed in his brilliant cross examination, the 2 shameless criminals who run Singapore today, not without the help of a turbaned fool of a crony lawyer and a woman high court judge who allows herself to be bought over by the unjustified high salary paid to her by her master, thereby compromising the rule of law, which is sacred to the very survival of any nation for the sake of future generations. For such ruthless inhuman devils my suggestion is that there should be a revolution in that country to bring all these criminals and their collaborators to justice! When that moment arrives we will see if they can show courage and speak as boldly as they do today? Justice is long overdue. Maybe it might come sooner as the unrepentant old fool is closer to his end than he thinks. That is inevitable and immiment and the likes of Ms Judge and Mr Singh together with the unelected and illegitimate PM better prepare for it!

    Actually, the court hearing was to determine the quantum of damages and not to establish liability so to be honest Chee seems to me on the wrong track. That is out of order. He shld have used the very first trial to cross examine LKY in this same way, and demanded that LKY answer all the questions that LKY promised he'll do. So Chee is I wld say out of step. Soin this last encounter, Chee could defend himself against high claims of costs by alluding to the lack of circulation or publicity he was given by the continued clamp downs etc or cited the percentage of votes he got anyway at the GE or question howmuch impact his words had on the PAP's percentage votes etc.
    So maybe Chee knows the difference but chose to make as much political capital out of this last hearing.

    I really don't understand Dr. Chee. He is obviously not a stupid man. In fact, he is quite intelligent.

    Why is it that he cannot use the many available methods available to him to make his views known instead of being so confrontational all the time?

    Such a waste of intelligence and because of his methods, its such a waste of a chance for a passionate man like Dr Chee to be of any real use to the Democratic process in Singapore.

    This is tragic. Dr Chee simply doesn't have a clue about how things work. The earlier proceeding is on liability - almost anything would have been relevant for that proceeding. But the current proceeding is merely on liability. Different lah. Also, Dr Chee has watched too much Matlock -- y'know when Matlock asks incisive questions and gets the witness to break down and confess on the stand? Well, that is Hollywood man. It don't happen like that in real life. Go get a clue.

    I listen this clip as a neutral bystander and am no supporter of Lee. Both Lee and Chee were equally eloquent so I don't know where the part where Chee is above Lee. But Chee is a younger man and will have a faster mind. At first I thought Lee stammered but it is maybe because he don't want to answer some questions because he doesn't want to go out of point. There was also 2 parts where Chee paused.

    Like almost everything else on the internet, we should not be too trusting of what we see/hear.

    We should not be given the impression or come to the conclusion that the entire court proceedings went like how it is heard here. What is posted up is probably as small portion of what happened.

    My main point is that we should not just trust what we hear to be the truth. The most hardcore skeptic may even say the audio recordings are not tamper-proof etc (you get my drift).

    I am NOT just a blur PAP/LKY supporter rooting for them blindly (I'm not even sure who to support). Rather, I feel the need to say that the postings here, like in any other media, is also subjected to a level of biasness which we need to be aware of.

    While it may not an accurate portrayal of the court happenings, what we can take away is the knowledge that the mainstream media is not being very truthful in their portrayals either.

    You've seen - heard, rather - the performance of Our Dear Leader when in court with no one else around and facing Ah Juan who's never trained in law and how ARTICULATE he was, haven't you?

    So, if even the head of Cabinet got cum-stuck-in-throat facing down someone he and Dad has devoured all their lives (not to mention having the most quick-witted legal brain in Singapore in the form of Dave SingTel to aid and calm him in court), how do you expect his underlings to perform if they had to do LIVE???

    They'll tell you: Limpeh rather die than have the camera showing me dumbstuck every time an impromptu question gets shoved in my face - tolong you all, don't do this kind of live events to make limpeh laukwee,okay? Cut $2 off my next pay but please, please tolong, tolong don't ever do this, pureeeeeeeeeeeeeease.

    My god, these cabi.net people can't even outtalk the lousiest Taiwan local councillor, you expct them to do live???

    Its very interesting that Dr.Chee has made a brace showing of his political guts by asking Lee Kuan-Yew questions unrelated to the Quantum of Damages issue,the sole rationale for Court Hearing.Shouldn't Dr.Cee be speaking about these matters at the Speakers Corner at Hong Lim Green ? If the police deny the Permit he can appeal first to Singapore Courts then ultimately to the International Court of Justice at The Hague,Netherlands!Singapore already has a poor record of Media Freedom !     SDP, please demonstrate your belief for a fair country by posting the clip for the entire court proceedings instead of just a few selected recordings? That will be the best way for us to to have a good understanding of the case, including the party's stand.

    Dr chee , you should have be asking him why the number of PAP voters has declined in all these years and why singapore is facing a brain drain situation. This would be relevant to the singaporeans' interest.Let him know we are having difficulties in our life because of the decision made in influx of large unskilled and skilled foreigers are robbing our jobs away. I meant foriegner young at age stands a higher chance in securing a job than the older singaporean.do not ask those nonsensical questions

    CSJ is an idiot. I am not for everything that happens, but we will not be where we are if not for LKY in the early years. We cannot have everything perfect. If you think that you have what it takes to do better than that old man.. go prove yourself in a proper manner. Look at Chiam ST.. i respect him for winning over through hard work and logic. CSJ really gives the opposition a bad name. Kind of saddens me to know that he is no better than alot of Americans who think that they are the only ones doing a good job.

    Frankly, after hearing the live audio from the court proceedings, I think not having it broadcasted would actually help the cause of the SDP, because, in one word, it was rather disappointing.

    I clicked the broadcast quite eagerly, because I never thought such a broadcast will actually make it out of a court-room. Morever, when the one being cross-examined was none other than our MM, Mr. Lee.

    Looking at the tag line, I expected a cross-examination by Dr Chee that would have left Mr Lee flabbergasted, since the title did say "lost for words"

    What I heard and read, however, were REALLY disappointing. It consisted of jibes, parries, and frankly speaking, it was really 5 minutes of time wasting. There were many questions, thtt I thought Dr Chee wanted to ask Mr Lee, and I would say, get on with it. I would rather hear about pertinent questions that all singaporeans really want to know about, like with regards to CPF savings, or maybe questions regarding the formation of GIC, and it's transparency. I believe these questions were brought up by Dr Chee before especially in condemning the current government.

    Those were the issues that I wanted to hear about. Not 5 mins of, in my opinion, sparring with words that amounted to nothing. so what did Dr Chee proved or achieved in the end? Frankly,I don't know... but I hope somebody does, otherwise, I would really hate to see him always being in jail all the time, or being in the news for all the wrong reasons.

    I don't hate you Dr Chee, we are all fellow Singaporeans. I just hope that you will be able to live well, and find peace within yourself and also those around you. Life is too short sometimes.
